What is the difference between an OWI, a DUI or a drunk driving charge?
Essentially, these are the same thing, each involving operating a motor vehicle while under the influence of alcohol or drugs.
In an OWI case, how long will my license be suspended?
If it is your first offense, you can expect your license to be suspended for at least 60 days. If it is at least your second offense, you can expect your license to be suspended for a minimum 180 days. Ask us about your ability to get
Will I have to go to jail?
Again, if this is your first offense, and only a misdemeanor charge, you may not face any jail time. Often, if jail time is required, you can do it on home detention. Expect to have some jail time for any felony conviction.
Should I talk to the police?
If you are being investigated for a crime, we advise our clients not to speak to the police. The only time you would want to speak to the police is if you have an attorney present.
The police never read me my rights before they arrested me?
It is misconception – mostly from watching “cop shows” – that the police have to read you your rights before or at the time you are arrested. The only time they have to read you your rights is if they want to ask you questions while “in custody”.
Can I have my criminal record expunged?
Indiana now has the “second chance” law which allows individuals to expunge their criminal record and arrests under certain circumstances. Schedule an appointment to see if you qualify.
